This circular is about the initiation of bargaining for a new Secondary Teachers' Collective Agreement.

This circular does not replace any other.

The action needed is to bring the Notice of Initiation of Bargaining to the attention of all employees whose work may be covered by the collective agreement, within ten days of receipt of the attached notice.

It is intended for Chairpersons of Boards of Trustees and Principals of all state and state-integrated secondary schools (as advised in the attached notice) to bring to the attention of all teachers employed in such secondary schools.

Introduction

Section 43 of the Employment Relations Act 2000 (the Act) requires that, on receiving a notice of intention to bargain a collective agreement under the Act, details of that notice are to be drawn to the attention of all employees who come within the coverage of the intended agreement within ten days of receiving that notice.

Notice of Initiation - secondary school teachers

On 31 August 2018 the New Zealand Post Primary Teachers' Association Te Wehengarua (NZPPTA) confirmed the details with the Secretary for Education, of a formal initiation of bargaining for the renewal of the Secondary Teachers’ Collective Agreement (STCA). The current collective agreement expires on 27 October 2018.

The NZPPTA advises that the intended parties to the STCA are the Secretary for Education, acting under the delegation of the State Services Commissioner, and the NZPPTA and is intended to cover teachers who are, or who become NZPPTA members in secondary (Year 9-13) schools and their subsidiary units; teachers in Year 7-13 schools and their subsidiary units; and specialist secondary teachers of Year 7 and 8 technology courses employed in primary or intermediate schools or their subsidiary or attached units; and teachers in composite (other than area) schools and special schools and units who teach students Year 9 and above; and itinerant teachers of instrumental music employed by secondary schools; and secondary teachers responsible for teaching and learning programmes for students Years 9 and above, or across Years 7-10 in Te Aho o Te Kura Pounamu (the Correspondence School), and/or support for those students, the responsibility may be in the development and/or delivery of these programmes or support; and RTLB who are no longer covered by clause 1.4(a) of the STCA after 28 January 2012 (but who were covered by it as at 27 January 2012) and who accepted employment in the new lead employing school, so long as they remain employed as an RTLB with that lead school employer and remain a member of the NZPPTA.

A copy of the Notice of Initiation of Bargaining for the Secondary Teachers' Collective Agreement [PDF, 60 KB] needs to be provided to any employee(s) that may be covered by the renewed Secondary Teachers’ Collective Agreement as soon as possible.
