Managing school boards of trustees’ payrolls
Redundant operational specifications have been removed from section 89 of the Education Act 1989. The Education Act 1989 has been amended by the Education Legislation Act 2016 that came into force on 29 October 2016.
Section 89(1) of the Education Act 1989 required the Secretary for Education to “ensure that there are established and maintained, within or on behalf of the Ministry, staff and facilities for, and sufficient for, servicing the payroll of boards”.
Impact of the legislation
The change brings the legislation into line with current practice and is unlikely to have any practical impact. The amendment allows more flexibility in how the payroll service is delivered and does not change the current payroll arrangements.
The amendment does not affect the legal responsibilities of the Secretary for Education, any person, or entity in delivering the payroll service.
Why the change?
It is increasingly unusual for operational specifications to be included in an Act. The Secretary for Education’s ability to determine the most efficient and effective arrangements for delivering a payroll service is constrained by the requirement that he or she should establish and maintain sufficient staff and facilities.
