This circular is about the initiation of bargaining for a new Primary Teachers' Collective Agreement.

This circular replaces does not replace any other.

The action needed is to bring the Notice of Initiation of Bargaining to the attention of all employees whose work may be covered by the collective agreement, within ten days of receipt of this notice.

It is intended for Chairpersons of Boards of Trustees and Principals of all state and state integrated primary schools (as advised in the attached notice) to bring to the attention of all teachers employed in such primary schools.

Introduction

Section 43 of the Employment Relations Act 2000 (the Act) requires that, on receiving a notice of intention to bargain a collective agreement under the Act, details of that notice are to be drawn to the attention of all employees who come within the coverage of the intended agreement within ten days of receiving that notice.

Notice of Initiation - primary school teachers

On 17 April 2018 the New Zealand Educational Institute Te Riu Roa (NZEI Te Riu Roa) confirmed the details with the Secretary for Education of a formal initiation of bargaining for the renewal of the Primary Teachers’ (including Deputy and Assistant Principals’ and other unit holders) Collective Agreement. The current collective agreement expires on 8 June 2018.

The NZEI Te Riu Roa propose that the Agreement entered into by the Secretary of Education, acting under the delegation of the State Services Commissioner, and the NZEI Te Riu Roa is intended to cover teachers, speech language therapists, and untrained employees in teacher positions who are employed in primary schools (including normal schools, model schools, and intermediate schools); composite schools (other than area schools, excluding teachers in composite schools who predominantly teach students classified as year 9 or above) including the primary sections of the Te Aho o Te Kura Pounamu and Te Aho o Te Kura Pounamu Specialist Services; special schools; intermediate departments, special classes or attached special education units of secondary schools; and Resource Teachers Learning and Behaviour (RTLB) who were no longer covered by clause 1.3(a) of the Primary Teachers' Collective Agreement 2010-2012 after 28 January 2012 (but who were covered by it as at 27 January 2012) and who accept employment in the new lead school, so long as they remain employed as an RTLB in that lead employing school and remain a member of NZEI Te Riu Roa; and any such school that is also established as a kura kaupapa Māori or that has any additional designation or status under the Education Acts 1964 and 1989.

A copy of the Notice of Initiation of Bargaining for Primary School Teachersneeds to be provided to any employee(s) that may be covered by the proposed Primary Teachers’ (including Deputy and Assistant Principals’ and other unit holders) Collective Agreement, as soon as possible.
